These Terms of Service ("Terms") govern your use of the Troqai mobile application and Troqai Merchant platform, both operated by Draitek. By downloading or using the App, you agree to be bound by these Terms.
1. About Troqai
Troqai is a travel discovery application developed by Draitek. The App is available worldwide, welcoming travellers from anywhere in the world to explore local places, upload authentic travel photos, and access personalised itineraries.
2. Eligibility
- You must be at least 13 years of age to create an account.
- Users under 18 must have parental or guardian consent.
- One account per person. Duplicate accounts are prohibited.
3. User Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at support@troqai.com if you suspect unauthorised access.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. User-Generated Content
4.1 Ownership & Licence
- You retain full ownership of photos and content you upload.
- By uploading, you grant Draitek a non-exclusive, royalty-free, worldwide licence to display and distribute your content within the App and related marketing materials.
- For content rewarded with points, this licence continues after account closure — uploaded photos and contributions already rewarded remain part of the Troqai community platform and are not removed upon account deletion.
- You may delete individual content items at any time prior to account closure.
4.2 Content Rules
- All photos must be original images taken by you personally.
- AI-generated, manipulated, or stock images are strictly prohibited and will be rejected without notice.
- Photos containing people or faces are not permitted in community uploads to protect personal privacy.
- Content must not be offensive, misleading, defamatory, sexually explicit, or violate any third-party rights.
- We reserve the right to remove violating content without prior notice.
5. Premium Subscription (User)
Troqai Premium is a user subscription that unlocks itinerary generation, itinerary check-ins, and enhanced reward multipliers. This is separate from Merchant plans.
- Troqai Premium is available at USD 1.99 per month, billed through Apple App Store or Google Play.
- Payment is charged to your App Store or Google Play account upon confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Manage or cancel your subscription via your App Store or Google Play account settings at any time.
- No refunds for the unused portion of a subscription period, except where required by applicable law.
- Draitek reserves the right to change subscription pricing with at least 30 days' prior notice.

6.2 Redemption & Expiry
- Reward points have no monetary value and cannot be withdrawn as cash or transferred to another account.
- 1,000 points may be redeemed for one month of Troqai Premium access (equivalent to USD 1.99).
- Voucher and coupon redemption options are coming soon.
- Points expire 12 months after the date they were earned.
- Draitek reserves the right to adjust point values, earn rates, or redemption rates with prior notice.
⚠ Anti-Fraud: Any attempt to artificially inflate points through fraudulent check-ins, duplicate accounts, scripts, or referral abuse will result in immediate account suspension and forfeiture of all accumulated points.
7. Prohibited Conduct
- Uploading AI-generated, fake, or stock photography.
- Creating false or misleading place information or reviews.
- Using bots, scripts, or automated tools to interact with the App.
- Attempting to reverse-engineer, decompile, or tamper with the App.
- Using the App for any unlawful purpose or in violation of any applicable law.
- Harassing, threatening, or abusing other users.
8. Intellectual Property
All App content, design, trademarks, logos, and software are the property of Draitek or its licensors. You may not reproduce, redistribute, or create derivative works without prior written permission from Draitek.
9. Disclaimers
- The App is provided on an "as is" and "as available" basis without warranties of any kind.
- Place information is user-generated and may not be accurate or current. Troqai does not guarantee the accuracy of any place listing.
- We do not guarantee uninterrupted or error-free operation of the App.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Draitek shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of revenue, or personal injury.
11. Termination
- You may delete your account at any time via App settings or by contacting support@troqai.com.
- We may suspend or terminate your account immediately for breach of these Terms.
- Upon termination, your right to use the App ceases and any unredeemed points are forfeited.
12. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes via in-app notification or email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
14. Merchant Terms (Additional)
The following additional terms apply to businesses registered as Troqai Merchants. Merchants must also comply with all general Terms above.
14.1 Merchant Eligibility
- Merchants must be a legally registered business or sole proprietor operating in an eligible country.
- The business must be a real, physical place that users can visit (restaurant, hotel, attraction, spa, shop, etc.).
- Troqai reserves the right to approve or reject any merchant application without obligation to provide reasons.
- One merchant account per business outlet. Multiple branches or outlets require separate listings.
14.2 Merchant Plans & Radar Radius
All Troqai Merchant plans are paid subscriptions. The only difference between plans is the radar radius — the straight-line distance within which your promo pop-up is shown to nearby Troqai users.

Note: Radar radius is measured as a straight-line distance from your outlet coordinates, not road distance. Actual reach may vary based on user location and device settings.
14.3 What All Merchant Plans Include
- Radar pop-up promotion shown to nearby Troqai users within your plan's radius.
- 60-second promotional video upload.
- Menu or product image upload.
- Contact / booking button (WhatsApp or website link).
- Featured in unlimited Surprise / Mystery picks for users exploring nearby.
- Performance analytics — reach and views dashboard.
14.4 Merchant Content Rules
- Merchant photos may include staff and customers only with their explicit consent.
- Photos must accurately represent your current business. Misleading imagery is prohibited.
- AI-generated images are strictly prohibited.
- Promotional videos must not contain explicit content and must comply with applicable age-rating guidelines.
- All content is subject to Troqai moderation before publication. Videos may take up to 3 business days to review.
- Promo banners must state accurate prices, validity dates, and terms.
14.5 Merchant Responsibilities
- Keep all business information (name, address, operating hours, category) accurate and up to date.
- Respond to user reviews professionally.
- Comply with all applicable local laws, health regulations, and business licensing requirements.
- Not engage in any practice designed to artificially inflate ratings or solicit fake reviews.
- Notify Troqai immediately if your business permanently closes or changes location.
14.6 Merchant Fees & Billing
- All merchant plans are paid subscriptions billed monthly, every 3 months, or annually as selected.
- Subscriptions auto-renew unless cancelled before the renewal date.
- No refunds for partial subscription periods, except where required by applicable law.
- Troqai reserves the right to suspend listings for non-payment after a 7-day grace period.
- Pricing may vary by country. Current prices are displayed in the Troqai Merchant app at sign-up.
14.7 Reviews & Ratings
- Community reviews are independent and cannot be edited or deleted by merchants.
- Merchants may flag reviews that violate Troqai's content policies for moderation review.
- Troqai does not guarantee any minimum rating or number of reviews.
14.8 Affiliate Links
- Hotel and accommodation listings may include affiliate booking links (e.g. Agoda) that generate commission for Troqai.
- Merchants may not request removal of affiliate links from their listings.
14.9 Merchant Account Termination
- Merchants may close their account at any time by contacting merchant@draitek.com.
- Troqai may suspend or terminate a merchant account for breach of these terms or fraudulent activity.
- Upon termination, all merchant-uploaded content will be removed within 14 days. The place listing (community data) may remain as part of the public database.
⚠ Zero Tolerance: Any merchant found to be engaging in fake reviews, misleading promotions, or harassment of community users will have their account permanently suspended without refund.

This Privacy Policy explains how Draitek collects, uses, stores, and protects your personal information when you use the Troqai App or Troqai Merchant platform. By using either platform, you consent to the practices described in this policy.
1. Data Controller
Draitek International Sdn Bhd is the data controller responsible for your personal information collected through the Troqai App and Troqai Merchant platform. Contact: support@troqai.com
2. Information We Collect
2.1 Information You Provide (Users)
- Account data: Name, username, email address, password (hashed), profile photo, and country of residence.
- User content: Photos, reviews, comments, and place updates you submit.
- Support communications: Any messages you send to our support team.
2.2 Information You Provide (Merchants)
- Business data: Business name, address, GPS coordinates, category, operating hours, contact details.
- Merchant content: Photos, promotional videos, banners, and menu images uploaded to your listing.
- Billing information: Processed via Stripe. Draitek does not store full card details.
2.3 Information Collected Automatically
- Location data: Precise GPS coordinates — collected only when you actively perform a check-in (users) or when setting your outlet location (merchants). We do not track your location in the background.
- Usage data: Features used, itineraries generated, check-ins performed, and session duration.
- Device data: Device model, operating system version, app version, and unique device identifiers.
- Log data: IP address, timestamps, and crash reports for debugging purposes.
2.4 Information from Third Parties
- Apple / Google Sign-In: Name and email as permitted by those services.
- Payment data: User subscriptions processed by Apple App Store or Google Play. Merchant subscriptions processed by Stripe. Draitek does not receive or store your payment card details.
- Google Places API: Used to populate place data, subject to Google's Privacy Policy.
- Agoda affiliate: Hotel listing links generate anonymised click data for commission tracking. No personal user data is shared with Agoda.

4. Location Data
Troqai requests location permission only when you tap the check-in button (users) or when setting your outlet location (merchants). Location is not tracked in the background. Merchant radar radius is calculated from your registered outlet GPS coordinates — user precise location is never shared with merchants.
5. Content Moderation & Privacy
Troqai uses automated AI content moderation (Sightengine) to ensure community photos are appropriate and respect human rights. Photos containing faces or identifiable people are automatically rejected — this is by design to protect personal privacy. Images are processed in real-time and not stored by Sightengine beyond the moderation check.
6. How We Share Your Information
- We do not sell your personal data to any third party.
- Other users: Your username, profile photo, uploaded photos, reviews, and tier level are visible to other App users as part of the community features.
- Merchants: Merchants only see anonymised analytics (views, radar reach counts). Individual user identities are never disclosed to merchants.
- Service providers: Supabase (database), Google (Places API), Stripe (merchant payments), Sightengine (content moderation) — all contractually obligated to protect your data.
- Legal requirements: We may disclose your data if required by law, court order, or to protect the rights and safety of Draitek or its users.
- Business transfer: In a merger or acquisition, your data may transfer to the successor entity under the same privacy protections.
7. Data Retention
- Account data is retained for as long as your account is active.
- Uploaded photos and reviews are retained until you delete them or close your account.
- Merchant listing data is retained while the merchant account is active. Upon closure, content is removed within 14 days.
- Reward point transaction logs are retained for 24 months for audit purposes.
- Log data and crash reports are retained for a maximum of 90 days.
- Upon account deletion, personal data is deleted or anonymised within 30 days, except where retention is required by law.
8. Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal data:
- Access: Request a copy of the personal data we hold about you.
- Correction: Request correction of inaccurate or incomplete data.
- Deletion: Request deletion of your account and associated personal data.
- Portability: Request your data in a machine-readable format.
- Objection: Object to processing based on legitimate interest.
- Withdraw consent: Where processing is based on consent, withdraw at any time.
Contact support@troqai.com to exercise any of these rights. We will respond within 30 days.
9. Children's Privacy
The App is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, contact support@troqai.com for immediate deletion.
10. Data Security
- All data transmission between the App and our servers is encrypted using TLS/HTTPS.
- Passwords are hashed using industry-standard algorithms and never stored in plain text.
- Access to user data is restricted to authorised Draitek personnel on a need-to-know basis.
- We conduct regular security reviews of our infrastructure.
- Despite these measures, no system is completely secure. We cannot guarantee absolute security of your data.
11. International Data Transfers
Your data may be processed and stored on servers located outside your country of residence. We ensure that such transfers are protected by appropriate safeguards in compliance with applicable data protection laws.
12. Third-Party Links & Services
The App integrates with third-party services including Google Maps, Apple / Google Sign-In, Stripe, Sightengine, and Agoda. This Privacy Policy does not apply to those services. We encourage you to review their respective privacy policies.
13. Cookies & Tracking
The Troqai mobile app does not use browser cookies. We use anonymous analytics identifiers to understand App usage patterns. These identifiers are not linked to your name or email address.
14. Changes to This Privacy Policy
We will notify you of significant changes via in-app notification or email at least 14 days before the change takes effect. The "Effective Date" at the top of this page reflects the most recent update.
15. Governing Law
This Privacy Policy is governed by the laws of Malaysia (Personal Data Protection Act 2010 — PDPA). As Troqai serves users globally, we also endeavour to comply with applicable data protection laws in other jurisdictions, including Singapore (PDPA), Thailand (PDPA 2019), Indonesia (UU PDP), Philippines (Data Privacy Act 2012), and the European Union (GDPR) where applicable.
